軍審法明總統府公告　洪案最快16日移交法院

《軍事審判法》8月6日經立法院火速修正，馬英九總統已在紐約簽署，總統府明（14）日正式公告、15日生效。軍人在承平時期犯凌虐部屬等罪，預計最快本週五(16日)移交一般法院審理，社會關注的洪仲丘案也將一併移交司法處理。

立法院6日通過修正《軍審法》，採「一階段到位、兩階段實施」，現役軍人在承平時期犯《陸海空軍刑法》裡的凌虐部屬等罪，將回歸一般司法機關審判。

總統府13日上午刊登公報公布軍事審判法第1條、第34條及第237條條文，軍人在承平時期犯凌虐部屬等罪，預計最快16日移交一般法院審理，洪仲丘案也將一併移交司法。

司法院將於13日下午召集全國一、二審法院的行政庭長，確認軍審案移交司法後，各地方法院成立軍事專業法庭、分案等細節。

對於外界關注的軍審官、軍檢官日後出路，國防部法律事務司審判處副處長沈世偉13日表示，國防部將從長計議後再跟外界說明。
