教唆殺人 角頭楊定融判11年定讞

台中角頭「楊定融」兩度教唆少年殺手廖國豪殺人，其中一件是社會矚目案件翁奇楠命案，另一件是餐廳老闆遭槍擊案，最高法院審理餐廳老闆被槍擊案，查出廖國豪受「楊定融」指示，朝餐廳老闆連開九槍，導致對方重傷，因此判處楊定融有期徒刑十一年定讞。

角頭楊定融與少年殺手廖國豪，三年多前曾在台中犯下震驚社會的翁奇楠命案，不過兩人在翁奇楠命案前，廖國豪也曾受楊定融指示槍殺另一名趙姓男子未遂。判決書指出，民國97年7月間，楊定融在台中市一家PUB與趙姓男子發生糾紛後，竟教唆廖國豪謀害趙姓男子。廖國豪先發出緝殺令，再跟蹤趙姓男子並適時回報楊定融對方的作息狀況，直到隔年一月，廖國豪持槍埋伏在趙姓男子經營的餐廳附近，見趙姓男子出現隨即開槍追殺。廖國豪一路追到市場，才因人多放棄追殺，但趙姓男子已經中槍受傷，送醫急救才悻免於死。

最高法院支持更二審見解，認定楊定融只因細故就謀議槍殺被害人，居於主導地位，讓廖國豪在大馬路邊近距離朝被害人開槍，手段殘暴，因此以成年人與少年共同殺人未遂罪，判處有期徒刑11年定讞。
